Equine Photoshoot Terms & Conditions

The Photographer agrees to provide the following services to the Client:
Photography for: Equine photoshoot (including general shots such as individual horse portraits, action shots, and any other equine-specific images). The Photographer will work with the Client to capture the Client's requested shots, as long as these requests are safe and not potentially harmful to the horse, rider, or the Photographer.
Number of hours of coverage: To be agreed upon based on the shoot’s scope and requirements.Location(s) of photoshoot: To be decided by the Client and Photographer, ensuring it’s a suitable and safe environment for both horse and rider.
Additional Notes: The Photographer will strive to capture the horse in natural poses, action shots, and any requested specific moments (i.e., grooming, jumping, etc.). If the Client requests photos with multiple horses, please inform the Photographer beforehand.

The Client agrees to pay the Photographer for the equine photoshoot services as follows:
Free Photoshoots: Some photo shoots may be offered free of charge. In these cases, no deposit or booking fee is required. However, the Client may still be responsible for any additional costs incurred during the session, such as travel or venue fees, which will be outlined at the time of booking.
Paid Photoshoots: For photoshoots with an associated fee, the following payment terms apply:
Non-refundable deposit: A non-refundable deposit is required to secure the photoshoot date. This deposit will be credited toward the final price.
Remaining balance: The remaining balance for the photoshoot is due on or before the day of the photoshoot.
If the Client cancels the photoshoot, the deposit will not be refunded under any circumstances.

Cancellation Policy: The deposit is non-refundable if the Client cancels the photoshoot. If the Client cancels, no portion of the deposit will be refunded.
Rescheduling: If the Client needs to reschedule the photoshoot:
The deposit can be carried over to a new date as long as the Client reschedules at least 24 hours in advance.
If the Client reschedules less than 24 hours before the photoshoot, the deposit will be forfeited, and a new deposit will be required for the rescheduled session.
Rescheduling Due to Photographer's Unavailability: In the rare event that the Photographer is unable to attend the photoshoot due to unforeseen circumstances (such as illness or emergency), the Photographer will work with the Client to find an alternative date or offer a full refund of the deposit.

The Photographer reserves the right to cancel or reschedule the session if the environment is not safe for the horse, rider, or photographer.
The Photographer will use reasonable efforts to ensure the safety and well-being of all animals involved during the photoshoot.
All images captured, including those of the horse and rider, remain the property of the Photographer. The Client may use the images for personal purposes but may not alter or sell any images without written permission.

The Client must ensure that the horse(s) is well-prepared for the shoot, including grooming, haltering, and being well-behaved for the duration of the session.
The Client is responsible for providing a safe environment for both the horse, the photographer, and themselves. This includes ensuring the location is secure, and the horse cannot escape or become agitated during the photoshoot.
Horse Management: The Client is responsible for the care and management of all horses during the photoshoot. If multiple horses are involved, the Client should ensure that they have additional help or assistance available to manage the horses. The Photographer is not responsible for handling or managing horses at any point during the photoshoot.
The Client should notify the Photographer if the horse has any behavioural issues, health concerns, or special needs.
The Client must ensure the safety of themselves, the horse(s), and the Photographer during the session, including any necessary precautions to prevent injury or harm.
The Client should provide the Photographer with a list of desired shots, including any specific poses or moments they would like captured, at least 48 hours before the photoshoot so the Photographer has time to prepare.

The Photographer aims to deliver the final edited images within two weeks of the session date.
However, this timeline is not guaranteed, and delivery may be subject to factors such as the complexity of the edit, workload, or unforeseen circumstances.
All images will be provided via an online album and/or We Transfer links for easy downloading. -
The Photographer is not liable for any injury, loss, or damage that may occur during the photoshoot, including injuries to the horse, rider, or any other persons.
The Client agrees to assume all risks associated with the equine photoshoot and will hold the Photographer harmless from any claims arising from the Client's actions or omissions.
The Client must ensure that the horse is in good health and appropriately trained for the photoshoot to avoid accidents or injury.
The Client is responsible for any damages or injuries caused by the horse during the session, including but not limited to damage to the Photographer’s equipment or injury to any individuals on site.

The Photographer will not be held responsible for failure to perform the services due to circumstances beyond their control, such as extreme weather conditions that may make the location unsuitable for the photoshoot (e.g., heavy rain, snow, or extreme heat).

The Client grants the Photographer permission to use images of their horse and themselves for promotional purposes, unless specifically opted out in writing. This includes use on social media, websites, portfolios, and other promotional platforms.

By proceeding with the photoshoot booking and/or participating in the photoshoot, the Client acknowledges that they have read, understood, and agree to be bound by these Equine Photoshoot Terms & Conditions. The Client confirms that they are the rightful owner of the horse(s) being photographed and that all necessary permissions and safety measures have been put in place for the session.
The Client also confirms that they are responsible for ensuring the horse is in good health, well-behaved, and appropriately trained for the photoshoot and will take necessary precautions to ensure the safety of the horse, themselves, and others involved in the photoshoot.
The Photographer reserves the right to update or amend these terms at any time. Any changes to the terms will be communicated to the Client prior to the photoshoot.
Sports Photoshoot Terms & Conditions

The Photographer agrees to provide the following services to the Client:
Photography for sporting event coverage as agreed upon through communication before the event.The Photographer will work with the Client to capture both general images of the event and any specific shots or moments the Client has requested, as long as they are reasonable and safe to capture.
The Photographer will discuss and confirm specific shot preferences, timing, and coverage beforehand.

The Client agrees to pay the Photographer the total amount for the services provided. The following payment schedule applies:
If applicable, a non-refundable deposit is due within 48 hours of signing the agreement to secure the booking.
The remaining balance must be paid no later than 48 hours before the event.
Payments should be made via BACS or another mutually agreed method.

For Clients who have paid only the deposit: If the Client cancels the session, the deposit is non-refundable. The deposit secures the Photographer’s time and resources for the event, and once the booking is made, it cannot be refunded, regardless of when the cancellation occurs.
For Clients who have paid in full: If the Client cancels the session, the full payment is non-refundable. The full payment secures the Photographer’s time and resources for the event, and once the booking is made, the full payment will not be refunded if the session is canceled. However, if the Client cancels more than 24 hours before the session takes place, the Client may reschedule, and the payment can be carried over to the new date.
Rescheduling: If the Client needs to reschedule, the deposit or full payment can be carried over to the new date, provided that rescheduling occurs more than 24 hours before the original event. Rescheduling must take place within 30 days of the original session date; otherwise, the deposit or full payment will be forfeited.
If the Photographer is unable to perform the services due to illness, injury, or unforeseen circumstances beyond their control (such as equipment failure), the Photographer will attempt to find a suitable replacement or offer a full refund of any deposits paid.

The Photographer retains the copyright to all images taken during the session/event. The Client, by booking the services, grants permission for the Photographer to use the images taken at the event for promotional purposes, including but not limited to social media, portfolio, website, and advertising. This includes images of athletes or other subjects captured during the event.
The Client also confirms that they have obtained permission from any relevant individuals (athletes, team members, etc.) for the Photographer to take and use their images as outlined above. The Client agrees to indemnify the Photographer in the event that any individuals, organizations, or other parties object to the use of these images.

The Client is responsible for ensuring that the event location is suitable and safe for photography, including all equipment and subjects involved in the session. The Client must ensure that any permissions required for photography at the event or location are obtained prior to the session. The Client agrees to provide a list of any specific shots they would like taken at least 48 hours before the event or session.

The Photographer aims to deliver the final edited images within two weeks of the session date. All images will be delivered via online albums and/or WeTransfer links for the Client to download unless otherwise specified.
However, this timeline is not guaranteed, and delivery may be subject to factors such as the complexity of the edit, workload, or unforeseen circumstances. -
The Photographer is not liable for any injuries, loss, or damage that may occur during the photoshoot or event. The Photographer is not responsible for the loss or damage of any property that occurs while present and/or if the environment is deemed unsuitable or not fit for purpose. The Client agrees to indemnify and hold harmless the Photographer from any claims arising from the Client’s actions or omissions during the event. Any damage or injury that occurs to participating individuals, athletes, or property is not the responsibility of the Photographer. Any equipment damaged during a photoshoot session will be covered by the party deemed to have caused the damage.

The Photographer will not be held responsible for failure to perform the services due to circumstances beyond their control, including but not limited to natural disasters, illness, strikes, or accidents.

By proceeding with the photoshoot booking and/or participating in the photoshoot, the Client acknowledges that they have read, understood, and agree to be bound by these Sports Photography Terms & Conditions.
The Client confirms that they have made all necessary arrangements and have received any required permissions for photography at the event, and that all participants (athletes, team members, etc.) have been made aware that they will be photographed.The Photographer reserves the right to update or amend these terms at any time. Any changes to these terms will be communicated to the Client prior to the photoshoot.
